Purpose & Scope of Position
The Contracts Specialist is responsible for managing the contractual aspects of engineering projects, ensuring compliance with all terms and conditions, and facilitating smooth project execution. This role involves drafting, negotiating, and administering contracts while working closely with project teams, clients, and suppliers. The incumbent leads a team of contract specialists and has vital responsibilities in carrying a project to an on-time, on-budget completion. He/She is the owner of the entire contracting process, both pre and post award activities. The responsibilities include negotiating the terms and conditions in contracts and ensuring compliance with the terms and conditions, including documenting and agreeing on any changes that may arise during its implementation or execution. The role involves systematically and efficiently managing contract formation, execution/administration, and analysis for the purpose of maximizing financial, scope and schedule related performance and minimizing risk.
Experience
• A minimum of 15 years relevant experience with minimum of 10 years relevant experience in Contracts. • Prior experience with Design-Build and professional services contracts is required with advanced knowledge of Design Build contract risks and interpretations, including Progressive Design Build.
Qualification
• Graduate or Post-Graduate in Engineering with Master's degree in Business Administration or Contracts Management credentials, preferred.
1. Provide leadership to the Contract Management function including pre-award Procurement, Contract Administration, claims management / dispute resolution, and contract close-out for piling related contracts. 2. Organizing and chairing of all regular commercial meetings, ensuring actions are clearly recorded and regularly updating their status, to ensure Subcontractor’s adherence to the Contract terms under which the Subcontract is administered and any supporting addendums 3. Review of Periodic Reports issued by the EM/PM, confirming accuracy of information, adherence to the Contract terms and any other agreements, and regularly assessing progress against the latest accepted schedule 4. Review and preparation of Change Certificates. seeking signatories for approval of changes, in accordance with project’s Levels of Authority Matrix. 5. Sharing of information in relation to payment, schedule, risk and scope change to the wider commercial team (finance, cost, project controls, prime contract) on a monthly basis or as dictated by the Prime Contract, and to the wider project team as requested 6. Develops, revises, negotiates, and administers contracts, bids, and proposals that meet specifications (in coordination with the business) from proposal stage to project close-out in accordance with relevant regulations and best commercial practice. 7. Advise the Leadership Team on all contractual matters and claims requiring escalation. Provides advice on and interpretation of contract requirements and risk mitigation strategies. 8. Leads the development of internal contract team by providing guidance and work leadership to less-experienced contracts/subcontracts administrators and managers. 9. Attend Contractor and Consultant progress meetings as required. 10. Review of tender documents in respect of contractual matters, scope gaps and discrepancies and managing the closure of these matters as required. 11. Participate on Commercial Evaluation Panel during the procurement process. 12. Provide formal written reports on the Contracts and Procurement status and issues to management.
